Acceptance: By using the Sakayna platform you agree to these Terms of Service.
Platform Role: Sakayna is a digital platform connecting passengers and independent riders.
- User Responsibilities: Users must provide accurate information and must not create fraudulent accounts.
- Rider Responsibilities: Riders must maintain valid licenses, safe vehicles and follow local traffic laws.
- Prohibited Actions: Fake rides, abuse of referral systems, fraud or illegal use of the platform are prohibited.
- Account Suspension: Sakayna may suspend accounts that violate platform rules.
- Governing Law: These terms are governed by the laws of the Republic of the Philippines.

Sakayna is committed to protecting personal information in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173).
Information Collected from All Users:
- Full name and mobile phone number
- Email address (optional, for account recovery only)
- Ride records (pickup, destination, timestamps, fare)
- Device and browser information
Additional Information from Drivers: Government ID, driver's license, vehicle OR/CR, verification selfie, GCash number, and real-time location (during active shifts with consent).
Legal Basis: Data is processed based on user consent, contractual necessity, legitimate interest (safety/fraud prevention), and legal obligation.
Data Retention: Ride records retained 3 years ยท Rider documents retained for active period + 1 year ยท Incident records retained 5 years ยท Deleted accounts purged within 30 days.
Information Sharing: Sakayna does NOT sell personal data. Data shared only for ride operations, legal compliance, or with infrastructure providers under strict agreements.
Your Rights: Right to access, rectify, erase, object, and port your data. To exercise rights, contact Sakayna via sakayna.com. Complaints may be filed with the National Privacy Commission at privacy.gov.ph.
Security: All data stored on encrypted cloud infrastructure. HTTPS/TLS in transit. Rider documents restricted to admin access only. Data breach notification within 72 hours as required by law.
1. Platform Purpose
Sakayna GenSan is a community booking platform โ not a transport operator. Sakayna does not own vehicles, does not employ riders, and does not provide transportation services. Sakayna is a technology platform that connects passengers with independent, self-employed local riders who independently set their availability and accept bookings at their own discretion. Its purpose is to verify rider identity, facilitate ride bookings, log trip records, and provide basic complaint and safety support.
2. Rider Verification
All riders must submit valid identification and vehicle documents before being activated. Verification is reviewed manually by the Sakayna admin team. Approved riders receive a Verified status on their profile. Unverified riders cannot accept bookings.
- Government-issued ID required
- Rider's license required
- Vehicle OR/CR required for motor, sedan, and SUV categories
- Verification review: 24 to 48 hours
3. Platform Fee Policy
Sakayna charges a fixed platform fee per completed ride only. No percentage commission. No monthly subscription. No hidden charges.
- Pilot period: โฑ0 platform fee for all Founding Riders
- After pilot: Fixed fee per completed ride (set by admin โ see Pricing page for current rates)
- Fees are per-ride only โ no monthly subscription, no percentage cut
- Cancelled rides: No fee charged under any circumstance
- Fee changes require 14 days advance notice to all riders
The fee structure may be reviewed after launch only if the platform can demonstrate measurable value. Riders will be notified at least 14 days before any fee change.
4. Booking and Cancellation
Passengers and riders are expected to honor confirmed bookings. Repeated cancellations or no-shows without valid reason may result in account warnings or suspension. The platform logs all booking activity.
- Cancelled rides are not charged a platform fee
- Fraudulent cancellations may be reviewed by admin
- Riders who repeatedly cancel may have their accounts flagged
5. Safety and Emergency
Sakayna provides basic safety tools during active rides including emergency contact access, SOS shortcut (calls 911), and in-app reporting. The platform logs trip routes and timestamps for all completed and active rides.
Passengers and riders are encouraged to use these tools if they feel unsafe. Reports are reviewed by the admin team within 24 hours.
6. Data Privacy
Sakayna collects mobile numbers, identity documents (riders only), trip records, and complaint logs. This data is used solely for platform operations, verification, and safety purposes.
- Passwords are stored in encrypted form
- Rider ID documents are accessible only to admin
- Trip records are retained for dispute resolution
- Users may request data deletion by contacting admin
7. Complaints and Disputes
Any passenger or rider may file a complaint through the app at any time. Complaints are reviewed by the admin team. Serious violations including fraud, harassment, or unsafe behavior may result in immediate account suspension pending investigation.
8. Account Suspension
Sakayna reserves the right to suspend or deactivate accounts that violate platform policies. This includes but is not limited to fake bookings, identity fraud, repeated no-shows, and reported harassment. Suspended users may appeal through the admin team.
9. Limitation of Liability
Sakayna GenSan is a coordination platform and is not liable for the conduct of individual riders or passengers during a trip. Users agree to use the platform at their own risk. Safety tools are provided as a supplement, not a guarantee.
10. Policy Updates
This policy may be updated as the platform evolves. Users will be notified of material changes. Continued use of the platform after notification constitutes acceptance of updated terms.
